Terms & Conditions
Program Purpose
SimToCircuit is a driver development and professional evaluation program. It uses racing simulation technology as a training and assessment tool, not as an amusement device or recreational game.
The purpose of the program is to evaluate driver skill, consistency, and racecraft; identify promising motorsport talent; provide structured advancement opportunities; and compensate drivers for participation in professional evaluation sessions.
SimToCircuit does not operate games of chance, gambling activities, or amusement-device prize contests.
Legal Classification
SimToCircuit is classified as a professional development and evaluation program. It is not a contest, sweepstakes, lottery, amusement-device reward system, or gambling activity.
Compensation provided to drivers is professional consideration for participation in structured evaluation sessions and is not awarded for gameplay or chance-based outcomes. The racing simulator is used solely as a training and assessment tool and is not operated as an amusement device.
Nature of Compensation
SimToCircuit compensates drivers for participation in structured evaluation sessions. This compensation is not a prize for gameplay. It is professional consideration for the driver's participation in a formal evaluation process, the performance data generated during sessions, and the driver's demonstrated skill and advancement potential.
SimToCircuit does not collect entry fees for race participation. The monthly membership fee is charged for platform access and not as consideration for a chance to receive compensation.
Compensation amounts correspond to the evaluation tier reached and are not awarded for the act of winning a game, but for achieving a qualifying performance level within the professional evaluation framework. Public-facing materials may use the term "prize" in motorsport-conventional contexts — this reflects industry terminology and does not alter the legal classification described here.
Membership & Access
The monthly membership fee of $10.00 provides access to the platform and its services, including evaluation sessions, analytics and performance data, structured heat progression, stewarding and officiating, and advancement opportunities.
Each billing cycle includes two (2) session access credits. These credits have no monetary value, are non-transferable, do not carry over (unused credits reset on your monthly billing date), and represent access rights only. Session credits exist solely to manage access to limited evaluation capacity. Membership fees are not contest entry fees and are not paid for a chance to receive compensation.
Credit usage rules and refund conditions are detailed in the SimToCircuit Competition Rulebook.
Evaluation Structure & Compensation
SimToCircuit's multi-heat format is a tiered evaluation system, not a prize contest. Advancement between tiers is determined exclusively by demonstrated performance against objective, measurable criteria published in the Competition Rulebook. Advancement decisions are not discretionary. Advancing to a higher heat is always free — no session credit is deducted upon advancement.
Compensation tiers (public-facing materials may refer to these as "prizes" — their legal classification is compensation for participation in a professional evaluation program):
Heat 1: $25 — 1st place Heat 2: $50 / $35 / $20 — 1st / 2nd / 3rd Heat 3: $200 / $125 / $75 — 1st / 2nd / 3rd Heat 4 (Final): $2,000 / $1,000 / $500 — 1st / 2nd / 3rd
Compensation is paid only for official sessions. A session is official only if at least 18 drivers have confirmed RSVPs and completed check-in at qualifying start. If fewer than 18 drivers are present, the session is marked unofficial and no compensation or season points are awarded.
No Gambling or Chance-Based Mechanics
SimToCircuit events are skill-based evaluations. The program involves no random outcomes, no chance-based mechanics, no wagering, no betting, no sweepstakes, and no lotteries. Drivers do not risk anything of value on the outcome of any session.
Classification of Simulation Technology
SimToCircuit uses simulation technology exclusively as a professional assessment and development tool. Sessions are structured evaluations of driver skill, not entertainment or amusement activities. The simulator is not used for entertainment, amusement, or recreational gameplay within the SimToCircuit program. Its purpose is skill assessment, performance analysis, driver development, and advancement evaluation.
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any dispute not resolved through the internal dispute process shall be subject to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah. You consent to personal jurisdiction in those courts and waive any objection to venue.
Nothing in this section limits SimToCircuit's right to seek injunctive or other equitable relief in any court of competent jurisdiction.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to this Agreement, your membership, or any evaluation session shall be resolved as follows:
Internal Resolution: Any active member may file a session dispute within 24 hours of result certification. Disputes filed after payouts have been marked as paid will not be accepted. Only one open dispute per member per session is permitted. Filing a dispute pauses all pending payouts for that session. Disputes are resolved by a SimToCircuit administrator whose decision is final with respect to the internal process.
Binding Arbitration: If a dispute is not resolved through the internal process, it shall be resolved by binding individual arbitration administered under AAA rules in Salt Lake County, Utah. The arbitrator's decision is final and enforceable.
Class Action Waiver: You waive any right to bring or participate in any class action, collective action, or representative proceeding. All disputes must be brought in your individual capacity only.
Small Claims Exception: Either party may bring an individual claim in small claims court if the claim qualifies under that court's jurisdictional limits.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMTOCIRCUIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, SPONSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY EVALUATION SESSION.
SIMTOCIRCUIT'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL MEMBERSHIP FEES YOU PAID IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SimToCircuit does not guarantee any minimum number of sessions, advancement opportunities, or compensation eligibility. Sessions may be declared unofficial and yield no compensation if minimum participation thresholds are not met.
Disqualification & Forfeiture
SimToCircuit reserves the right to disqualify a driver and forfeit any pending or unpaid compensation for: violation of iRacing's Terms of Service or sporting code during a session; deliberate contact, unsportsmanlike conduct, or manipulation of results; provision of false information during registration or identity verification; failure to maintain an active Stripe Connect account in good standing; or any breach of this Agreement.
All penalty decisions are published publicly on the SimToCircuit Penalty Log within 24 hours. Bans are permanent and public. Disqualified drivers forfeit all compensation associated with the affected session. Compensation already paid is not subject to clawback except in cases of fraud or deliberate result manipulation.
Tax Treatment
Compensation paid by SimToCircuit is reportable income. Drivers are solely responsible for reporting and paying all applicable federal, state, and local taxes on compensation received.
SimToCircuit will issue IRS Form 1099-NEC to any driver receiving $600 or more in compensation in a calendar year, consistent with applicable U.S. tax law. International participants are responsible for compliance with tax obligations in their jurisdiction. SimToCircuit's payout process is administered through Stripe Connect, which independently collects information required for tax compliance.
Age & Eligibility
You must be at least 18 years of age to maintain a SimToCircuit membership or participate in any evaluation session. By registering, you represent that you have an active iRacing membership; have no current or prior FIA International Competition License; have no current or prior professional racing contract; maintain an active SimToCircuit membership in good standing; and have a verified Stripe Connect account (required before entering any session).
SimToCircuit reserves the right to verify eligibility at any time and to suspend or terminate accounts found to be ineligible.
Data & Privacy
SimToCircuit collects performance data, session data, and identity information in the course of operating the platform. Performance and session data — including finishing positions, incident rates, consistency metrics, and participation history — is used to operate the evaluation program and may be shared with sponsors in aggregate or individually identified form for talent identification purposes. By participating, you consent to this use.
Identity verification and financial information is handled exclusively by Stripe. SimToCircuit does not store payment card data or government-issued identification.
You may request deletion of your account and associated personal data at any time by contacting SimToCircuit support. Deletion requests will be processed within 30 days subject to any retention obligations required by law or active dispute proceedings. See our Privacy Policy for full details.
Amendments
SimToCircuit reserves the right to modify this Agreement, the Competition Rulebook, compensation tiers, heat structure, eligibility requirements, and program rules at any time. Material changes will be communicated by email at least 14 days before taking effect.
Continued use of the platform after the effective date of any amendment constitutes acceptance of the revised terms. If you do not agree to amended terms, your sole remedy is to cancel your membership before the effective date.
